The Ministry of Labour and Social Welfare (STPS) reports that, in accordance with Articles 166 and 167 of the Federal Labour Act, women workers in period pregnant or nursing women should be excused from providing their services in undertakings or establishments which are highly prone to spread of swine influenza virus without suffering injury wages, benefits and entitlements.

In fact, women who are pregnant or are nursing their children, are protected by law in this period epidemiological contingency.

Federal Labour Law provides, inter alia, the right for those workers who do not use their work in unhealthy or dangerous, such as those which, by the nature of work, the physical, chemical or biological medium is provided, they can affect the life, development and physical and mental health of the woman was pregnant or product.

As such, pregnant workers and those who are feeding their children during this period of epidemic transmission, should receive from employers or employers, support and facilities to establish the legal provisions cited.

Moreover, it emphasizes that Article Six of the "Decree on the various actions are ordered in terms of general health, to prevent, control and combat the existence and transmission of seasonal influenza virus epidemic", published in Official Journal of the Federation on April 25, 2009, enjoins employers to provide support and facilities which provide the legal provisions of general health.

Therefore, the STPS urges all employers to comply fully with the laws in question and the decree referred to, to avoid risks to workers during periods of gestation or lactation provided that, in case of default, will be subject to the penalties which provides for the Federal Labor Act itself.
